Model contract for a private loan (onderhandse lening)

A model contract for a private loan does not need to be complicated, but it does need a few specific clauses. The Belastingdienst accepts a private loan as a real loan only when the agreement states the amount, the rate, the term and the repayment schedule, and both sides sign it.
What must be in the contract
Start with the basics: the full names of lender and borrower, the loan amount, and the payout date. Then the financial heart: the annual interest rate, the term in months, and whether repayment is annuity-style, linear or interest-only.
Add the payment rhythm (monthly is standard), the bank accounts involved, and what happens when a payment is missed. Close with signatures and the date. Digital signatures are legally valid in the Netherlands.
The clauses people forget
The most expensive omission is the rate. Without a market-conform rate the Belastingdienst can treat the forgone interest as a gift, with gift tax above the yearly exemption of €6,908 for a child in 2026.
Also often missing: whether early repayment is allowed without penalty, and how the rate is reviewed if market conditions change. One sentence each prevents later discussions.
